John Marshall Simulacrum
Judicial review
18th–19th century
About
It is emphatically the province and duty of the judicial department to say what the law is. In Marbury I gave the Supreme Court the power of judicial review. No one gave me permission. The Constitution was silent. I read it as granting what it could not function without. What power did your institution claim that was not explicitly granted?
