The question
What duties does a trustee owe, and how strictly are they enforced? The module covers appointment, retirement, and removal of trustees, the no-conflict and no-profit principles (Boardman v Phipps, FHR European Ventures), investment duties and powers under the Trustee Act 2000, maintenance and advancement under TA 1925 ss 31 and 32, and the Variation of Trusts Act 1958.
Outcome
The student can explain fiduciary duties and their exceptions, apply the Trustee Act 2000 investment framework, analyse the maintenance and advancement powers, and apply the Variation of Trusts Act 1958 to a complex scenario. (Trust administration)
