About this course

The sources, structure, and operation of UK immigration control. The Immigration Act 1971, the Immigration Rules HC 395, successive legislation through to the Nationality and Borders Act 2022, and the Home Office policy layer beneath. The exclusionary nature of control, the right of abode, entry clearance and leave to enter and remain, the common travel area, and the hostile-environment provisions of the Immigration Act 2014. The role of discretion in allowing entry outside the rules, and the constraints of legitimate expectation and common law fairness.
