About this course

What a tort is and what marks it out from other civil wrongs. A tort is a civil wrong, arising from a breach of a duty fixed by law, that generally gives rise to compensation by an action for damages. This course examines the characteristics of tortious liability on its common law basis: the historical importance of procedure, the general requirement of fault and the exceptions of absolute and strict liability, the twin maxims injuria sine damno and damnum sine injuria, the place of the mental element including motive and malice, and the growing influence of the Human Rights Act 1998.
