About this course

The torts that protect the use and enjoyment of land against interference. Private nuisance, the unlawful and substantial interference with a person use or enjoyment of land; public nuisance, now resting for its criminal limb on s 78 of the Police, Crime, Sentencing and Courts Act 2022 while the common law is retained for civil liability; and the rule in Rylands v Fletcher, the strict liability for the escape of a dangerous thing brought onto land in the course of a non-natural use. The course distinguishes the three, applies them to complex facts, and evaluates them.
