About this course

Whether the testator was capable of making the will, knew and approved its contents, and made it freely. Testamentary capacity, the rule in Banks v Goodfellow and its relationship with the Mental Capacity Act 2005, the time at which capacity is tested and the burden of proof; the requirement of knowledge and approval and the circumstances that displace the presumption; the effect of mistake and the court power of rectification under s 20 of the Administration of Justice Act 1982; and the vitiating factors of force, fear, fraud and undue influence.
