About this course

The court power to override a will or the intestacy rules where reasonable financial provision has not been made. The preliminary requirements of domicile and time; the categories of applicant under s 1, from spouse to dependant, and how the courts have applied them; the two standards of reasonable provision, the surviving-spouse standard and the ordinary standard; the common and particular guidelines under s 3; the orders the court may make; and the property available, the net estate, with the treatment of joint property and the anti-avoidance provisions.
